(2) I agree that I have examined and inspected the Vehicle and that it is in first class mechanical and over-all condition.
(3) I agree that I will not cause or allow the Vehicle to be loaned, rented, or driven by any person other than me, and that the Vehicle will not be driven
beyond a radius of 50 miles from the place at which I took delivery of the Vehicle.
(4) I agree that while this Agreement is in force I will preserve and protect the Vehicle from loss or damage. Subject to any limitations under California
law, I agree to be liable for all costs of repairs to the Vehicle regardless of fault. [ have been specifically advised to be certain that my own automobile insurance
coverage will provide for payment of such loss in the event of any accident.
(5) I agree that I will not use the Vehicle, or cause or permit the Vehicle to be used in any way whatsoever in violation or contravention of any Municipal,
County, State or Federal law, ordinance or regulation. I agree that I will not operate the Vehicle while under the influence of alcohol or narcotics, nor permit any
other person to do so.
(6) I agree that in the event of any accident involving the Vehicle I will, within 12 hours following the accident, furnish to you a full and complete accident
report, and will report the accident to the Department of Motor Vehicles of the State and to my insurer within the time and in the manner required by law and
required by my insurer. I agree that if the Vehicle and/or its accessories are lost, or destroyed, or if I lose possession of the Vehicle and am unable to return it to
you for any reason whatever, I will pay you the market value of the Vehicle and reasonable market value for loss of accessories, unless otherwise specified.
(7) Subject to any limitations under California law, I agree that I shall bear all expenses incident to the maintenance of the Vehicle. I agree to hold harmless
and indemnify you against all claims and demands arising or resulting from the use, storage and/or repairs of and to the Vehicle until the Vehicle is returned to
you.
(8) I covenant and agree with you that, subject to any limitations under California law, I will forever hold harmless and indemnify you from any and all
claims, demands, causes of action, attorneys fees and expense of any nature arising or alleged to arise from the use, operation, maintenance and ownership of the
Vehicle while this Agreement remains in force and effect, and to reimburse you for any loss or damage during that period. I further agree that in the event you
file any action to recover possession of or the value of or the cost of repairing the Vehicle, or in the event you employ an attorney to defend it in any action by
me or anyone else claiming for personal injuries, or ap damage, arising out of the use of the Vehicle while in my actual or constructive possession, to pay
you upon demand any and all reasonable sums you expend for attorney fees and court costs.
(9) 1 shall return the Vehicle to you at your place of business within _________ days from date, not to exceed four months from the date of this
Agreement, or before then on your demand. I also waive any claim that may hereafter arise for any and all damage I may hereafter sustain by reason of any action,
civil or criminal, which you or your Agents may take in connection with my use or retention of the Vehicle in the event of my failure to return the Vehicle to you.
(10) I hereby grant a security interest in my vehicle that was left in your possession to satisfy the obligations, if any, under this Agreement.
(11) T agree that I will, at my sole risk and expense, maintain Bodily Injury and Property Damage Liability Insurance and any other insurance required by
law covering the use of the Vehicle during the time it is in my possession and until I return the Vehicle to you. You shall not be required to carry or ie Bodily
Injury or Property Damage Liability Insurance during said period of time.
